Abergavenny Food Festival Competition

Terms and Conditions

  1. The prize draw is open to all UK residents aged 18 years or over, except employees of Ogi (being the trading name of Spectrum Fibre Limited, a company registered in England and Wales with registered number 12883320, and its registered office at Tŷ Ogi, Hodge House, 114-116 St. Mary Street, Cardiff, CF10 1DY) (“the Promoter”).  The prize draw is not open to any of the Promoter’s families, agents or any third party directly associated with administration of the prize draw.
  2. The prize draw is free to enter and no purchase is necessary.
  3. All entries must be submitted via the Promoter’s Facebook page, and entries shall be submitted via this route only.  Only one entry per person or one entry per household is permitted.  Each participant agrees to be bound by these terms and conditions and Facebook’s terms and conditions, to the extent relevant.
  4. The opening time for entries is on 10 September 2021. The closing date of the prize draw is 4pm on Thursday 16 September 2021.  Entries received after this time will not be accepted.
  5. The Promoter accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind or if for any reason a technical interruption, fault or site failure occurs when completing the submission.
  6. A winner will be chosen by random draw performed by a computer process OR supervised by an independent person on Thursday 16 September 2021.
  7. The winner will receive the following prize: A pair of “stroller” wristbands that allows access to the Abergavenny Food Festival site on Saturday 18 September 202, plus a pair of tickets to the party at the castle on the evening of Saturday 18 September 2021. Transport and accommodation will not be included.
  8. The winner will be notified by email and/or via the direct messaging feature on Facebook or telephone (using details provided at entry) before 4pm Friday 17 September 2021 and must be available to meet in person at an agreed place and time at the Abergavenny Food Festival to claim their prize and collect tickets. If a winner does not respond to the Promoter by midday Friday 17 September 2021, then the winner’s prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above.
  9. The Promoter will notify the winner of when and where the prize can be collected.
  10. The prize for the winner is non-exchangeable, non-transferable and no cash alternative is offered.
  11. The prize is supplied by Abergavenny Food Festival. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so.
  12. The decision of the Promoter regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.
  13. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of major prize winners and, if applicable copies of their winning entries, to anyone who emails [email protected] or writes to Tŷ Ogi, Hodge House, 114-116 St. Mary Street, Cardiff, CF10 1DY] (enclosing a self-addressed envelope) within one month after the closing date stated in these terms and conditions.  If you object to any or all of your surname, county and winning entry being published or made available, please contact [email protected] In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.  The winning participant agrees to his / her name and image being used in publicity material relating to the competition. 
  14. Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions.
  15. The Promoter reserves the right to hold void, cancel, suspend, or amend the promotion where it becomes necessary to do so.
  16. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
  17. Personal data supplied during the course of this promotion will only be processed as set out in the Promoter’s privacy policy: Our Privacy Policy  See also condition ‎13 with regard to the announcement of winners.  A participant acknowledges that personal data submitted to the Promoter via Facebook’s platform may also be subject to Facebook’s privacy policy terms which the participant confirms has been read and understood by the participant prior to entering the competition.  The Promoter does not have any control or influence over Facebook’s use of such personal data and the participant furthermore confirms that the Promoter does not have any liability in respect of any improper use of the participant’s personal data by Facebook or any other third party.  This prize draw is not sponsored, endorsed or administered by Facebook, twitter or any other social media platform. 
  18. The prize draw will be governed by the law of England and Wales and entrants to the prize draw submit to the jurisdiction of the English and Welsh Courts.
  19. The Promoter of this prize draw is set out in paragraph 1 above.
